1. Definitions and Interpretation
1.1 Defined Terms
- Agent: The installation contractor appointed by Urban Solar Africa who meets with the Customer at the Site and installs the Solar PV System.
- Business Day: Any day other than a Saturday, Sunday, or public holiday in South Africa, on which commercial banks are open for business.
- Agreement: The agreement for the purchase and installation of the Solar PV System between Urban Solar Africa and the Customer, as contained in the Order Form and these Terms and Conditions.
- Contract: The Agreement between the Parties for the completion of the installation works at the price specified in the Order Form, including the signed Order Form and these Terms and Conditions.
- Customer: The individual or entity purchasing the Solar PV System.
- Deposit: The initial payment made by the Customer to Urban Solar Africa as specified in the Order Form.
- Law or Laws: All applicable South African statutes, regulations, by-laws, and ordinances relevant to the Agreement, the Parties, and the Agent.
- Order Form: The document specifying the Solar System quote, signed by the Customer, to which these Terms and Conditions are attached.
- Outstanding Costs: The total cost payable by the Customer for the Solar PV System installation, as specified in the Order Form, minus any Deposit paid.
- REC: Renewable Energy Certificate.
- Site: The Customer’s premises where the Solar PV System is to be installed.
- Solar PV System: The solar photovoltaic system specified in the Order Form, purchased by the Customer and installed by the Agent.
- Urban Solar Africa : Trading as Urban Solar Africa .
2. Warranty and Guarantee
2.1 Workmanship Guarantee
- Urban Solar Africa guarantees all workmanship related to the installation, maintenance, inverter, and battery repair for a period of 3 to 6 months from the Date of Visit.
- If any issues arise during this period due to faulty workmanship, Urban Solar Africa will rectify them promptly at no additional cost to the Customer.
2.2 Solar PV System Warranty
- Urban Solar Africa provides a separate warranty for the Solar PV System components (panels, inverters, batteries, etc.) as specified by the manufacturers.
- The Customer is entitled to the manufacturer’s warranty, which typically extends beyond the workmanship guarantee.
3. Payment and Deposit
3.1 Deposit Payment
- The Customer shall pay the Deposit specified in the Order Form upon acceptance of the Agreement.
- Outstanding Costs shall be settled upon completion of the installation.
4. Legal Compliance
4.1 Laws and Regulations
- The installation shall comply with all relevant South African Laws and regulations.
- The Customer is responsible for obtaining any necessary permits or approvals required for the installation.
5. Miscellaneous
5.1 REC and Solar Credits
- Any Renewable Energy Certificates (RECs) or other monetary rebates payable by the relevant Government Department or Agency shall be credited to the Customer.
